1. Agreement to Terms

By accessing and using AI Post Maker (@dmproai_bot, "Service", "Bot", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

3. Description of Service

AI Post Maker is a Telegram bot that provides AI-powered content generation services, including:

• Blogger Posts: AI-generated images featuring the user's face as an expert, with accompanying text and hashtags
• Card Posts: Themed AI-generated images without personal photos, with text and hashtags

The Service uses artificial intelligence (AI) models to generate content based on user-provided prompts and photos. Content is delivered via Telegram.

4. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 16, you may not use the Service.

5. Account and Usage

• You must have a valid Telegram account to use the Service
• You are responsible for maintaining the confidentiality of your Telegram account
• You agree to provide accurate information when using the Service
• One account per person; no sharing or reselling of accounts

6. Payment Terms

6.1 Pricing

Current pricing (subject to change with 30 days notice):

• Blogger Post: 50 Telegram Stars (~$1.00 USD)
• Card Post: 25 Telegram Stars (~$0.50 USD)
• Welcome Bonus: 100 Stars free on first signup

6.2 Payment Method

All payments are processed through Telegram Stars, Telegram's native payment system. Payment processing is governed by Telegram's Terms of Service.

6.3 Star Packages

Users can purchase Telegram Stars in packages at current Telegram rates:

• 350 Stars: ~$6.59
• 500 Stars: ~$9.39
• 1000 Stars: ~$18.49
• 2500 Stars: ~$45.99

Prices may vary based on Telegram's exchange rates and regional pricing.

6.4 Taxes

As an Individual Entrepreneur registered in Georgia, we operate under the Georgian Small Business Status with a 1% turnover tax. All prices are inclusive of applicable taxes.

7. Refund Policy

7.1 Exceptions

Refunds may be considered only in the following cases:

• Technical Failure: If the Service fails to deliver content due to a technical error on our end
• Duplicate Charges: If you were charged multiple times for the same generation

To request an exception, contact @dmprobiz within 24 hours of the transaction with proof of the issue.

8. User Responsibilities

You agree NOT to use the Service to:

• Generate illegal, harmful, hateful, racist, sexist, or violent content
• Violate any third-party rights (copyright, trademark, privacy, etc.)
• Upload photos of other people without their consent
• Impersonate or misrepresent your identity
• Attempt to reverse-engineer or abuse the AI models
• Use automated tools or bots to access the Service
• Resell or redistribute generated content as a service

9. Content Ownership and License

9.1 Your Content

You retain all rights to photos and text prompts you upload ("Your Content"). By using the Service, you grant us a limited license to process Your Content for the purpose of generating requested content.

9.2 Generated Content

You own all rights to generated content. Once delivered, you may use, modify, and distribute generated content for any purpose, including commercial use, without attribution.

9.3 Our Rights

We reserve the right to use anonymized, aggregated data for service improvement and AI model training. We will never publicly share or sell your personal photos or generated content.

10. Service Availability

• The Service is provided "as is" and "as available"
• We do not guarantee 100% uptime or uninterrupted access
• We may suspend service for maintenance, updates, or technical issues
• We reserve the right to modify or discontinue the Service at any time

11. Content Quality and AI Limitations

We continuously improve our AI models, but we make no warranties about the accuracy, quality, or suitability of generated content. You are responsible for reviewing and verifying content before use.

12. Prohibited Content

We reserve the right to refuse generation or terminate accounts that request:

• Illegal content (drugs, weapons, terrorism, etc.)
• Adult/NSFW content
• Content depicting minors in any form
• Content that violates intellectual property rights
• Spam, scams, or fraudulent content
• Deepfakes or misleading content intended to deceive

13. Intellectual Property

The Service, including the bot interface, branding, and underlying AI technology, is protected by copyright and other intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Third-party claims arising from your use of generated content
• AI model errors or inaccuracies in generated content

Our total liability for any claim related to the Service is limited to the amount you paid in the 30 days preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless IE Damir Ziatdinov from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of third-party rights
• Your misuse of the Service or generated content

16. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or engage in prohibited conduct. Upon termination:

• Your unused Stars balance is forfeited (no refunds)
• You lose access to the Service
• Generated content already delivered remains yours

17. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which complies with GDPR and applicable data protection laws.

18. Dispute Resolution

18.1 Governing Law

These Terms are governed by the laws of Georgia. Any disputes arising from these Terms or the Service shall be resolved under Georgian jurisdiction.

18.2 Informal Resolution

Before initiating legal proceedings, you agree to attempt informal resolution by contacting us at@dmprobiz. We will make good-faith efforts to resolve disputes amicably.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be announced via the bot with 30 days notice. Continued use of the Service after changes constitutes acceptance of the new Terms.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
